Acceptance of Terms

By accessing or using our platform, services, websites, mobile experiences, or any related features (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Services.

Platform Description

Our platform enables users to discover titles, create watchlists, write reviews, join clubs, participate in trivia, and engage with community content related to movies and TV shows. We do not host or stream copyrighted content; we provide information, metadata, and community features.

User-Generated Content

You may submit content such as reviews, ratings, comments, posts, lists, and messages (“User Content”). You retain ownership of User Content, but you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, distribute, display, and create derivative works for operating, improving, and promoting the Services.

You represent and warrant that your User Content: (a) is accurate; (b) does not infringe any rights; (c) complies with law and these Terms; and (d) does not contain sensitive personal data of others without consent.

We may moderate, remove, or refuse User Content at our discretion, but we do not assume an obligation to do so. Community features may surface content that you disagree with; reporting tools are provided where appropriate.

Community Guidelines

You agree not to post or engage in: harassment; hate speech; threats; illegal content; explicit sexual or violent content without appropriate context or spoiler tags; spam; scams; impersonation; or activities encouraging piracy or illegal distribution.

We may limit features (e.g., posting, messaging, club creation) for accounts that violate guidelines or receive repeated reports. Repeated or severe violations may result in termination.

Spoilers and Ratings

Mark content containing spoilers accordingly. Misuse of spoiler tags, brigading ratings, or manipulating vote counts is prohibited.

Third-Party Data and TMDb Attribution

The Services may display information sourced from third parties. Where applicable, this product uses the TMDb API but is not endorsed or certified by TMDb. Data accuracy is not guaranteed; titles, credits, ratings, and metadata may be incomplete or outdated.

Prohibited Activities

You may not: (a) attempt to reverse engineer or disrupt the Services; (b) access without authorization; (c) use automated scraping beyond what is permitted by robots.txt or rate limits; (d) misuse APIs; (e) infringe intellectual property; (f) circumvent security or content protections; or (g) use the Services for unlawful purposes.

Memberships, Billing, and Refunds

Some features may require paid memberships or subscriptions. Prices, features, and terms will be disclosed at checkout. Subscriptions renew automatically until canceled. You may cancel anytime in account settings; cancellations take effect at the end of the current billing period.

Except where required by law or explicitly stated, fees are non-refundable. If a refund is granted, we may deduct amounts to cover used periods or benefits redeemed.

Advertising and Sponsorships

We may display ads or sponsored content. We are not responsible for third-party offers, products, or services. Interactions with third parties are solely between you and the third party.

Privacy and Data Protection

Intellectual Property

DMCA and Copyright Complaints

If you believe content infringes your rights, submit a detailed notice including your contact information, a description of the work, the URL(s), and a statement under penalty of perjury that you are authorized to act. We may remove content and, for repeat infringement, terminate accounts.

Feedback

If you provide suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNTS PAID BY YOU (IF ANY) DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

Indemnification

You agree to defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Services or violation of these Terms.

Termination

If arbitration is not enforceable, disputes shall be brought exclusively in the courts located in San Francisco, California.
